विवाहामुळे जात बदलली तरी आरक्षणाचा लाभ नाही

लग्नानंतर पतीचे नाव आणि गाव स्वीकारण्याची भारतीय परंपरा असली तरीही जर उच्च वर्गातील मुलीचा विवाह अनुसूचित जाती-जमातीत झाला तरी त्या वर्गातील आरक्षणामुळे मिळणारे शासकीय सेवेतील फायदे संबंधित महिलेला मिळू शकत नाहीत, असे स्पष्ट करणारा महत्त्वपूर्ण निकाल मुंबई उच्च न्यायालयाने दिला आहे.

यामुळे नोकरी किंवा अन्य लाभांसाठी विवाहाच्या मार्गाने आरक्षणाचा आसरा घेण्याच्या प्रवृत्तीला चाप बसण्याची शक्‍यता आहे.केवळ अनुसूचित जाती-जमातीतील तरुणाशी विवाह केला म्हणून आरक्षणाची मागणी करणे अप्रस्तुत आहे, असे मत न्यायालयाने व्यक्त केले आहे. नाशिक येथे राहणाऱ्या हेमलता मिलिंद बच्छाव यांनी न्यायालयात केलेली रिट याचिका न्या. रंजना देसाई व न्या. रोशन दळवी यांच्या खंडपीठाने नुकतीच फेटाळली आहे. आंतरजातीय विवाहाला प्रोत्साहन देणाऱ्या दोन शासकीय अध्यादेशांचा दाखलाही याचिकेत देण्यात आला होता. यानुसार पतीला मिळणारे फायदे पत्नीलाही मिळू शकतात; मात्र न्यायालयाने हा युक्तिवाद अमान्य केला.

अनुसूचित जाती-जमातींचा विकास करण्यासाठी घटनेत आरक्षणाची तरतूद केलेली आहे; मात्र काही उच्चवर्गीय लोकही या आरक्षणाचा लाभ खोटी प्रमाणपत्रे वा अन्य कोणत्या ना कोणत्या कारणाने घेताना आढळतात आणि हे अयोग्य आहे, या सर्वोच्च न्यायालयाने नोंदविलेल्या निष्कर्षाचा उल्लेख खंडपीठाने आपल्या नऊ पानी निकालात केला आहे. केवळ सहानुभूती म्हणून जरी याचिकाकर्त्याचे म्हणणे मान्य केले तरी ते कायद्याच्या आणि घटनेतील नैतिकतेच्या विरोधात असेल, असे नमूद करून न्यायालयाने जिल्हा परिषदेचा निर्णय योग्य असल्याचे स्पष्ट केले आहे.

न्यायालयाने दिलेला हा निर्णय योग्यच म्हणावा लागेल. कारण जातीचे बनावट प्रमाणपत्र तयार करून निवडणुका लढविणाऱ्यांची संख्या मोठी आहे. त्यातच विवाहानंतर जात बदलून आरक्षणाचा लाभ घेतला जाऊ शकतो. त्यामुळे न्यायालयाने दिलेल्या निर्णयामुळे अशांचा चपराक बसू शकेल, यात शंका नाही.

I think, actual need is to cancel all reservations based on caste. The reservation should be given to only those who are really below poverty line. On these grounds this is a very good decision by the court.

A very good decision by the court!! Reservation is for the benefit of only for those, who are backward. We must also restrict well-to-do families of backward class from taking these benefits which will pass the reservation benefits to the people who need them most.

१]श्री.संदिप यांनी म्हणल्याप्रमाणे सर्व प्रकारची आरक्षणे कायमची बंद करून टाकावीत कारण खोट्या जातीच्या दाखल्याच्या आधारावर शिक्षणात व
नोक-यात फ़ायदे घेणा-यांचे प्रमाण खूप आहे!
२]जोपर्यंत आरक्षण कायम आहे तोपर्यंत जी सवर्ण मुलगी नव-या मुलाची आरक्षित जात माहिती असूनहि स्वेच्छेने त्याच्याशी लग्न करते तिला त्याचा फ़ायदापण झालाच पाहिजे!
तिला सवर्ण असतांना कुठलीहि सवलत वा आरक्षण मिळत तर नाहीच,उलट कित्येक टक्क्यावरच्या संधी फ़क्त आरक्षित जातीच्या आधारावर मिळत असल्यामुळे शिक्षण वा नोकरीसाठी भयंकर झगडावे लागते व तिची खुपच उपेक्षा होते!
३]आपण आंतरजातीय,आंतरदेशीय विवाहांना मान्यता व प्रोत्साहन देतो तर एखादीने तसा केलाच तर तिने आधीची सवर्ण म्हणून संधी गमवायची ?
४]मतांच्या राजकारणामुळे जर आरक्षणे काढून टाकायच्याऐवजी वाढणार असतील तर सवर्णांनाहि आता आरक्षणे द्यायची वेळ आलेली आहे कारण त्यांनी कुणाचे घोडे मारलेले नाही!
५]कारण जातीचे बनावट प्रमाणपत्र तयार करून निवडणुका लढविणाऱ्यांची संख्या मोठी आहे हे मान्य असताना ते कसे चालते आपल्या उच्च न्यायालयाला?
किती अशा निवडणुका किंवा उम्मेदवार बाद होतात?
आरक्षणाच्या जागांसाठी इतकी झटापट असते त्या लोकांना व सत्ताधारी लोकांना खुष ठेवण्यासाठी हा पक्षपाती निर्णय घेतलेला दिसत आहे!

I appreciate the decision. Reservation is to be given to children who have been deprived of the opportunities from childhood, based on caste. If a girl was in general category then she had all opportunities. Why should she deserve reservation after marriage.

In general I don't like the idea of reservations. Also they are always said to be a temporary thing which should be removed after equality is restored. How do we measure equality ? what are the ways in which we can move towards no reservations ?

Very good decision taken by High Court.Its been observed that so many people take undue advantage of reservations based on casting system. If India needs to survive in the global market, this reservation system needs to be based on economic conditions not on cast. I know lot of people who take advantages of reservation however they own vehicles like Scoda,Innova and own multiple homes. Reservation has to be given to people who are really under powerty line and economically backward.Initially when cast based reservation system was created, it was created/designed for 10 yrs only.Our polititians have extended it further for thier own voting benifits.Not all but lot of people who get their jobs under reservation do not carry capabilities and you can see how Govt offices picture is these days.
Good decision, Bravo ...historical decision due to which taking undue advantage would be restricted.

I think she should get all the benefits. She is expected to bear the family name of her husband which in this case happens to be belonging to lower caste yet not get the benefits as awarded by the constitution.
That is double-dealing,at least to me.

But in case if a girl from backward class marries with open class boy then what is the decision of court? whether she will come under reserved catagory or not? This is for my information.

The real question is, whether marriage changes caste! I don't think so. What really constitutes a caste? Let me answer. If I marry somebody who is not of my caste, would I change my eating habit from vegetarian to non-vegetarian or Vice-Versa from next day? There lies the answer. Marriage does not change caste. A new inter-caste is created by fusion of two castes. e.g. Chandala was a fused caste for children of Sudra man and Brahmin woman.
